This podcast discusses changes in Title IX and Title VI enforcements, and how the new Trump administration is signaling enforcement differences. The podcast looks back at Supreme Court cases that have shaped civil rights law and its interpretation in education. The podcast discusses how these cases shaped Title IX and Title VI as we see them today, as these influence policies on admissions, athletics, sexual misconduct, and diversity initiatives. And finally, this podcast discusses how Title IX and Title VI can actually overlap some, and how the Trump administration is signaling future enforcements. One of the most controversial changes is the administration’s strict interpretation of sex as binary—male and female—rejecting protections for transgender students that were previously recognized under the Biden administration. This shift has led to new investigations targeting colleges that allow transgender women to compete in female sports or use women’s facilities. And the Trump administration has reinstated Title IX regulations from 2020, which provide greater protections for students accused of misconduct while reducing schools’ responsibility for off-campus incidents. The administration is also widening its scrutiny of colleges, beyond just the Ivy league. This creates some uncertainties, and forces administrators to reassess their policies and compliance strategies.
